R6 Cluster for Scientific Computing (CSC) terms of service

1. Introduction

The R6 CSC is currently in private preview.

This R6 CSC Subscription Agreement (“Agreement”) is entered into between the Molecular Modelling Laboratory GmbH (MML, “Provider”) and the subscriber (“Subscriber”) who accesses and uses the R6 CSC. By subscribing to and using the R6 CSC, the Subscriber agrees to abide by the terms and conditions outlined in this Agreement. If the Subscriber does not agree to these terms, they must discontinue use immediately.

2. Definitions

  • R6 CSC: The high-performance computing (HPC) infrastructure and associated services provided by MML for scientific computing purposes.
  • Subscriber: Any individual, institution, or entity that subscribes to and uses the R6 CSC.
  • Subscription Term: The period during which the Subscriber has access to the R6 CSC, subject to renewal and termination conditions.
  • Authorized Users: Individuals permitted by the Subscriber to access and use the R6 CSC under the Subscriber’s account.

3. Subscription and Access Rights

3.1 Right to Use

The Provider grants the Subscriber a non-exclusive, non-transferable, and revocable license to access and use the R6 CSC for research and development in compliance with this Agreement.

3.2 Account Creation and Authentication

To access the R6 CSC, the Subscriber must activate and maintain a usage quota and provide accurate, complete, and current information. The Subscriber is responsible for maintaining the security of their account credentials and ensuring that only Authorized Users access the R6 Cluster.

3.3 Acceptable Use

The Subscriber agrees to use the R6 Cluster only for lawful and ethical scientific computing purposes. Prohibited activities include, but are not limited to:

  • Engaging in any activity that violates applicable Swiss and international laws, including United States government sanctions regulations and ethical guidelines.
  • Uploading, processing, or storing data that infringes on intellectual property rights or contains harmful content.
  • Attempting to compromise the security or integrity of the R6 CSC.
  • Overloading the system with excessive or unauthorized computational tasks that negatively impact other users.

3.4 Modifications to Services

The Provider reserves the right to modify, update, or discontinue any part of the R6 CSC at its discretion. The Provider will notify the Subscriber of any significant changes that may affect their usage.

4. Fees and Payment

4.1 Fees

R6 CSC fees are based on R6 CSC infrastructure resources allocated to the Subscriber. Fees are subject to change. Please address fees- and consumption-related queries to hpc@mmlpi.ch.

4.2 Billing and Payment Terms

The Subscriber agrees to pay all fees associated with their use of the R6 CSC within the time frame specified in the invoice. Late payments may result in account suspension or termination.

4.3 Refund Policy

Fees paid are non-refundable.

5. Data Ownership and Confidentiality

5.1 Data Ownership

The Subscriber retains ownership of all data uploaded, processed, or stored on the R6 CSC. The Provider does not claim ownership of any Subscriber data.

5.2 Confidentiality and Security

The Subscriber is responsible for ensuring appropriate data security and backup procedures.

5.3 Data Retention and Deletion

The Subscriber is responsible for retrieving their data before the end of their Subscription Term. The Provider reserves the right to delete any Subscriber data within 30 days after subscription termination.

6. Service Availability and Support

6.1 Uptime Commitment

The Provider aims to maintain a high level of service availability. However, occasional downtime for maintenance and updates may occur.

6.2 Technical Support

The Provider offers technical support for issues related to R6 Cluster access and operation. Support inquiries should be directed to hpc@mmlpi.ch.

7. Limitations of Liability

To the fullest extent permitted by law, the Provider shall not be liable for:

  • Any indirect, incidental, or consequential damages arising from the use or inability to use the R6 CSC.
  • Loss of data, research progress, or computational results.
  • Any unauthorized access to the Subscriber’s data or account.

8. Termination and Renewal

8.1 Renewal

The Subscriber may renew their usage quota at any time.

8.2 Termination by Provider

The Provider reserves the right to suspend or terminate the Subscriber’s access to the R6 CSC if they violate any terms of this Agreement.

9. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of Switzerland. Any disputes arising from this Agreement shall be resolved through mediation or arbitration before resorting to litigation. The courts of Switzerland shall have exclusive jurisdiction over any legal proceedings related to this Agreement.
